Waiver and Liability
In consideration of the risk of injury while participating in Pottery and/or Ceramics activities (the "Activities"), and as consideration for the right to participate in the Activity, I hereby, for myself, my heirs, executors, administrators, assigns, or personal representatives, knowingly and voluntarily enter into this waiver and release of liability and hereby waive any and all rights, claims or causes of action of any kind whatsoever arising out of my participation in the Activity, and do hereby release and forever discharge Sad Friends Ceramics LLC, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns, for any physical or psychological injury, including but not limited to illness, paralysis, death, damages, economical or emotional loss, that I may suffer as a direct result of my participation in the aforementioned Activity, including traveling to and from an event related to this Activity.
I AM VOLUNTARILY PARTICIPATING IN THE AFOREMENTIONED ACTIVITY AND I AM PARTICIPATING IN THE ACTIVITY ENTIRELY AT MY OWN RISK. I am aware of the risks associated with traveling to and from as well as participating in this Activity, which may include, but are not limited to, physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and death. Nonetheless, I assume all related risks, both known or unknown to me, of my participation in this Activity.
I agree to indemnify and hold harmless Sad Friends Ceramics LLC against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney's fees and any related costs.
I give Sad Friends Ceramics LLC permission to publish in print, electronic, or video format the likeness or image of myself and/or my work for the general promotion of Sad Friends Ceramics LLC and its programs.
I acknowledge that I have carefully read this "Waiver and Release" and fully understand that it is a release of liability. I expressly agree to release and discharge Sad Friends Ceramics LLC from any and all claims or causes of action.
In the event that I should require medical care or treatment, I agree to be financially responsible for any costs incurred. I am aware and understand that I should carry my own health insurance.
In the event that any damage to equipment or facilities occurs as a result of my or my family's willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs.
1. Studio Conduct, Building & Community Respect
To maintain a safe and professional environment, I agree to the following:
- Mutual Respect: I will treat all those around me with kindness and respect. Harassment, verbal abuse, or disruptive behavior will not be tolerated and is grounds for immediate removal from the program.
- Shared Environment: I will respect the work and personal space of others. I will not touch, move, or handle any ceramics or tools that are not my own.
- Cleanliness: I will clean my wheel, tools, and workspace after every use. I will dispose of clay and glaze according to studio protocols to prevent plumbing issues (e.g., using designated clay traps).
- Prohibited Content: I will not use studio resources to create work that invokes, promotes, or displays hate speech or hate symbols. The studio reserves the right to refuse to fire such work and terminate participation immediately.
- Building Security & Respect: I will treat the physical studio and surrounding building (entryways, elevators, restrooms) with care. I will not prop open secure doors, share entry codes, or allow "piggybacking" by unauthorized individuals.
- Respect for Neighbors: I will keep noise levels to a minimum when entering and exiting the building. I will park only in designated areas and avoid blocking neighboring driveways or shared access points.
- Termination of Participation: I acknowledge that Sad Friends Ceramics LLC reserves the right to terminate my participation in any class or workshop, effective immediately and without refund, if I violate any studio policies, building rules, or conduct guidelines.
- Authorized Access & Timing: I will limit my use of the studio strictly to my scheduled class or workshop times. If my class includes Open Studio Access, I will only access the space between 10 AM and 6 PM PST. Unauthorized use of the space outside of these hours is prohibited.
- No Unauthorized Guests: I understand that registration is for the enrolled student only. I will not bring guests, friends, children, or pets to accompany me or remain in the studio during my session.
2. “Kiln Gods” Clause - Firing Results & Abandoned Property
Ceramics is unpredictable. The studio is not liable for pieces that crack, break, or have unexpected glaze results. Items not picked up within 30 days of the final firing will be considered abandoned and may be discarded or donated.
3. Media & Photo Release
I grant Sad Friends Ceramics LLC permission to use photos or videos of me and my work for promotional purposes.
